LegalRight of Withdrawal.

This notice applies if you are a consumer, meaning you are buying wholly or mainly for purposes outside your trade, business, craft or profession, and you are habitually resident in

• a member state of the European Union
• Iceland, Liechtenstein or Norway, if we deliver there
• the United Kingdom.

It applies to orders placed on the Site for delivery to an address in a country we deliver to. If you live in Italy or Spain, where we do not currently deliver, you can still order for delivery to an address in a country we do deliver to and this notice applies to you in the same way.

You have the right to withdraw from your contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier who you have nominated, take physical possession of the products. If you order several products in 1 order and they are delivered separately, the period expires 14 days after the day you, or your nominee, take physical possession of the last product.

To use your right of withdrawal, you must tell us of your decision by a clear statement before the withdrawal period expires. You can do this in any of the following ways.

• Withdrawal function. Select Withdraw from contract here on this page. The same link appears in your order confirmation email and in your account. You will be asked for your name, your order number and the email address where you would like to receive our confirmation, and then to select Confirm withdrawal. You do not need an account to use it, and it is available for the whole withdrawal period.
• Email. Send a message to concierge@skingraphica.com with your name, order number and the products you wish to return.
• Post. Write to us at SKINGRAPHICA PTY LTD (ACN 684 257 261, ABN 54 684 257 261), The Trust Building, Suite 703, Level 7, 155 King Street, Sydney NSW 2000, Australia.
• Model form. You may use the model withdrawal form in clause 12, but you do not have to.

To meet the withdrawal deadline, it is enough for you to send your communication before the withdrawal period expires.

When you withdraw, we will send you an acknowledgement by email without undue delay. If you use the withdrawal function, the acknowledgement will set out the content of your withdrawal statement and the date and time you submitted it. It will also include your prepaid, tracked return label.

Our products are applied to skin, including newly tattooed skin, and are delivered with a hygiene seal. The law makes one exception to the right of withdrawal that is relevant to them.

The right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery. This means that

• if you break the hygiene seal on a product after it is delivered to you, you can no longer withdraw from the contract for that product
• you keep your right to withdraw for every product whose hygiene seal remains intact
• opening the shipping carton or the outer packaging without breaking the hygiene seal does not affect your right
• if a product arrives with its seal already broken or damaged, the exception does not apply and you should contact concierge@skingraphica.com because the product may also be faulty.

Every product in our SYSTEM, SYSTEM PLUS and SYSTEM LUX collections is individually packed and sealed. If you unseal some products in a collection, you can still withdraw for those that remain sealed. We will refund a fair proportion of the collection price, based on the individual prices of the sealed products you return. The SYSTEM LUX collector’s edition box does not need to be returned unopened.

Please make sure you are happy with a product before you break its seal.

You can cancel the purchase of a digital gift card within 14 days of buying it, provided it has not been used. We will refund the amount paid in full.

If you withdraw from your contract, we will reimburse all payments we received from you for the products concerned. This includes the import VAT and any duties we collected at checkout and the cost of delivery. We will not reimburse the extra cost of any delivery option you chose that was more expensive than the least expensive standard delivery we offered.

We will make the reimbursement without undue delay and no later than 14 days after the day on which we are informed of your decision to withdraw. We will use the same means of payment you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the products back or you have supplied evidence of having sent them back, whichever is earlier.

If you withdraw from only part of an order, we will reimburse the price of the products you return and, if no products from the order remain with you, the standard delivery cost.

You must send back the products, or hand them over to us, without undue delay and no later than 14 days after the day on which you tell us that you are withdrawing. The deadline is met if you send back the products before the period of 14 days has expired.

With our acknowledgement we will send you a prepaid, tracked return label. Please attach it to your parcel and keep proof of postage.

We will bear the cost of returning the products.

You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning. You can look at a product and its outer packaging in the way you would in a shop. Breaking a hygiene seal is covered by clause 5 rather than this clause.

If you live in the United Kingdom, your right to cancel comes from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The right works in the same way as described in this notice.

• You may cancel within 14 days after the day you, or your nominee other than the carrier, take physical possession of the products, or of the last product if they arrive separately.
• You can cancel using the withdrawal function, by email to concierge@skingraphica.com, by post or using the model form in clause 12.
• The right does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons once they have been unsealed after delivery. It continues to apply to products whose seal is intact.
• We will refund you, including standard delivery costs, within 14 days after we receive the products back or you supply evidence of having sent them back, whichever is earlier.
• You must return the products within 14 days after telling us you are cancelling. We send you a prepaid, tracked return label, so the return costs you nothing.

Your rights under the Consumer Rights Act 2015 for faulty or misdescribed products are not affected.

This notice is about your right to change your mind. It does not affect your rights if a product is faulty, not as described or damaged in transit. In the European Union you have a legal guarantee of conformity for at least 2 years from delivery and in the United Kingdom you have rights under the Consumer Rights Act 2015. To make a claim, contact concierge@skingraphica.com.

Our voluntary change of mind policy in our Terms of Service allows returns of unopened products with the hygiene seal intact within 30 days of delivery. You can rely on whichever of that policy or this notice gives you the better outcome.

Complete and return this form only if you wish to withdraw from the contract. You can copy it into an email to concierge@skingraphica.com or send it by post.
